These terms govern your use of the CyberByte website (the “Site”), operated by CyberByte Pty Ltd. By using the Site you agree to these terms. If you do not agree, please do not use the Site.

Use of the site

You may use the Site for lawful purposes only. You must not use it in any way that breaches applicable laws, infringes another party's rights, or interferes with the Site's operation or security.

Informational only — not security advice

The content on this Site is general information about our services and the cyber security landscape. It is not tailored security, legal or professional advice, and you should not rely on it as such. We provide formal advice only once you are engaged under a written contract with a defined scope. Nothing on the Site creates an advisory or testing relationship.

Intellectual property

All content on the Site — including text, branding, graphics and layout — is owned by or licensed to CyberByte Pty Ltd and protected by intellectual property laws. You may view and download material for your own reference, but you must not reproduce, republish or commercially exploit it without our written permission.

Engagement terms

Any work we perform is governed by a separate written engagement, not by this Site. As a guide, our engagements are typically:

• Fixed-price — scoped and quoted up front, with no hourly billing or lock-in.
• Deposit-based — commonly a 50% deposit on booking, with the balance payable on delivery.
• Authorised in writing — any security testing is governed by a signed authorisation-to-test that defines scope, timing and rules of engagement before any work begins.

Where the engagement contract and these terms differ, the engagement contract prevails.

No warranty

The Site is provided “as is”. To the extent permitted by law, we make no warranties about its accuracy, completeness or availability, and we are not liable for any reliance you place on its content. Nothing in these terms excludes rights you have under the Australian Consumer Law that cannot lawfully be excluded.

Limitation of liability

To the maximum extent permitted by law, CyberByte Pty Ltd is not liable for any indirect, incidental or consequential loss arising from your use of the Site. Our liability for engagements is governed by the relevant engagement contract.

Governing law

These terms are governed by the laws of Victoria, Australia, and you submit to the non-exclusive jurisdiction of the courts of that state.
